Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you ("User", "you") and True North Venture Group, LLC d/b/a Flight Engineer ("Company", "we", "us", or "our"), concerning your access to and use of the Flight Engineer mobile application and related services (collectively, the "App"). By creating an account or using the App, you explicitly agree to be bound by these Terms.

1. Strict Prohibition on Aviation Use (Not for Navigation)

FLIGHT ENGINEER IS STRICTLY FOR PASSIVE SITUATIONAL AWARENESS. IT IS NOT AN APPROVED AVIATION DATA SOURCE.

• You explicitly agree never to use the App, its map rendering, weather data, telemetry features, or notifications of any kind for primary flight navigation, aircraft dispatching, aeronautical decision-making, or compliance with Air Traffic Control (ATC) clearances.
• The data, tools, and interfaces provided by the App do not meet, and are not certified under, the regulatory standards of the Federal Aviation Administration (FAA), the European Union Aviation Safety Agency (EASA), the International Civil Aviation Organization (ICAO), or any other international, national, or local civil aviation authority. The App is not certified as an Electronic Flight Bag (EFB), a primary flight display, or an approved weather briefing source.
• You acknowledge that making physical aviation, dispatch, or piloting decisions based on the App's data poses a severe risk of injury, death, or regulatory enforcement action, for which you assume total and absolute liability.

2. Disclaimer of Third-Party Data & Accuracy

The App aggregates data from third-party application programming interfaces (APIs), unverified ADS-B telemetry networks, and external weather services. Therefore, the Company makes no warranties regarding the accuracy, completeness, or timeliness of the data.

• Latency and "Ghost" Tracks: Real-time flight tracking may experience significant latency, display inaccurate altitudes/speeds, or render "ghost" tracks of aircraft that are no longer airborne.
• Service Outages: True North Venture Group, LLC is not responsible or liable for any service, API, or network disruption to the App. The App is not a guaranteed communication or data delivery medium. The Company is not liable for data blackouts, delayed push notifications (including ground stop alerts), or failures originating from our third-party data providers.
• All tools, calculators, and telemetry readouts are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.

3. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall True North Venture Group, LLC, its members, managers, affiliates, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages.

If you are a commercial pilot, dispatcher, or aviation professional, you acknowledge that using unapproved applications may violate your employer's Operations Specifications (OpSpecs), standard operating procedures (SOPs), union agreements, or approved Electronic Flight Bag (EFB) protocols. You explicitly release True North Venture Group, LLC from any and all liability related to employment consequences, including but not limited to disciplinary actions, suspension, termination, union grievances, or employer-led litigation resulting from your use of the App while on duty, in the flight deck, or in connection with your professional responsibilities.

This limitation includes, without limitation, damages for loss of profits, loss of data, physical property damage, personal injury, regulatory fines, or FAA enforcement actions arising out of or related to your use of, or inability to use, the App. Because the App is provided to you at no cost, your sole and exclusive remedy for any dissatisfaction with the App is to uninstall it. Our maximum aggregate liability to you for all claims arising out of these Terms shall not exceed $0.00.

4. Indemnification

You agree to defend, indemnify, and hold harmless True North Venture Group, LLC, its affiliates, and respective directors, officers, and agents from and against any claims, actions, demands, liabilities, and settlements, including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms or your misuse of the App's data in an operational aviation environment.

5. Account Security & Disruption

Each User is responsible for any and all activities occurring under their account. You may not delegate, assign, grant, transfer, or share your access credentials with any other party. If you suspect your account has been compromised, you must promptly inform True North Venture Group, LLC.

True North Venture Group, LLC reserves the absolute right, in our sole discretion and without prior notice or liability, to suspend, terminate, or restrict your access to all or any part of the App for any reason, including but not limited to a breach of these Terms, excessive API usage, or suspected malicious activity. Upon termination, your right to use the App will immediately cease.

6. Prohibited Conduct & Data Scraping

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. You explicitly agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App or its underlying cloud infrastructure.
• Use any robot, spider, scraper, offline reader, or other automated means to access, extract, or index data from the App, its APIs, or its database.
• Interfere with or disrupt the security, integrity, or performance of the App, or attempt to bypass any rate-limiting or authentication measures.
• Use the App's data to build a competitive product or service, or redistribute the data without express written permission from True North Venture Group, LLC.

7. Intellectual Property Rights

The App, including its original source code, features, functionality, UI/UX design, and branding (including the "Flight Engineer" name and compass logo), are and will remain the exclusive property of True North Venture Group, LLC and its licensors. The App is protected by copyright, trademark, and other laws of the United States. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of True North Venture Group, LLC.

8. Apple App Store Addendum

If you downloaded the App from the Apple App Store, you acknowledge and agree that these Terms are concluded between you and True North Venture Group, LLC only, and not with Apple. We, not Apple, are solely responsible for the App and its content. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, but to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Collin County, Texas, and you hereby consent to the personal jurisdiction and venue therein.
